Welcome to WhatAVote ("we," "us," "our," or "the Company"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WhatAVote regarding your access to and use of our platform, website, mobile application, and all associated services (collectively, "the Service").

By accessing, browsing, or using WhatAVote in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms.

1. ELIGIBILITY AND USER REQUIREMENTS

1.1 Age Requirement
To use WhatAVote and participate in voting contests, you must be at least 13 (thirteen) years of age. Users aged 13-17 (thirteen to seventeen) years may participate in voting but are subject to the following restrictions:
• Prize money for users under 18 years of age will be credited to their parents' or legal guardians' bank accounts
• Users under 18 must provide parental consent to participate in contests involving prizes
• The parent or legal guardian becomes the legal recipient of all prizes won by minor users

Users aged 18 and above can receive prizes directly to their own bank accounts and contact information.

1.2 Geographical Restriction
WhatAVote is currently available exclusively for residents and citizens of India. International users are not permitted to register on or use the Service. By registering, you confirm that you are a resident of India and that you will comply with all applicable Indian laws and regulations.

1.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account information and mobile number. You agree to accept responsibility for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

1.4 Honest Information
You agree to provide truthful, accurate, and complete information during registration and at all times while using the Service. Providing false information may result in immediate account suspension and disqualification from all contests.

2. VOTING RULES AND REGULATIONS

2.1 Voting Mechanics
• Voting on WhatAVote is completely free. No charges, fees, or payments of any kind are required to cast a vote.
• Users are limited to a maximum of 10 (ten) votes per day across all shows combined.
• Users can cast a maximum of 3 (three) votes per show per day.
• Users can cast a maximum of 3 (three) votes per contestant per show per day.
• Votes are non-transferable and cannot be shared, sold, or exchanged with other users.
• Votes cast are final and cannot be changed or retracted once submitted.
• However, users may vote again on the same contestant on subsequent days (new votes, not changes to previous votes).

2.2 Voting Verification
• To vote, you must verify your mobile number using a One-Time Password (OTP) authentication system.
• Only verified mobile numbers are eligible to participate in contests and win prizes.
• Each mobile number can only be registered once on the WhatAVote platform.
• Attempting to register multiple accounts using different mobile numbers is strictly prohibited.
• Any violation of this rule will result in immediate account termination and disqualification.

2.3 Voting Integrity and Prohibited Activities
To maintain the integrity and fairness of our contests, the following activities are strictly prohibited:
• Using automated systems, bots, scripts, or any software to cast votes
• Manipulating votes through technical exploitation or hacking
• Colluding with other users to artificially inflate votes for any contestant
• Creating multiple accounts to circumvent voting limits
• Using VPNs or proxies to bypass geographical restrictions
• Selling or purchasing votes
• Engaging in any form of vote manipulation or fraud
• Using false, duplicate, or fraudulent identity information

Violations of these rules will result in:
- Immediate account suspension
- Permanent ban from WhatAVote platform
- Forfeiture of all prizes (won and pending)
- Disqualification from all current and future contests
- Legal action if necessary, including criminal prosecution for fraud

2.4 Daily Voting Opportunity
Users receive a fresh set of 10 daily votes at the beginning of each calendar day (12:00 AM IST). Unused votes from the previous day do not carry over to the next day. This ensures fair and equal voting opportunities for all users each day.

3. CONTESTS AND PRIZES

3.1 Prize Distribution Overview
WhatAVote distributes prizes to users as a reward for their participation in voting contests. The total number of prizes distributed per contest may vary but generally includes:
• 1 (one) Grand Prize: Luxury automobile (approximately ₹12,00,000 in value)
• Multiple Mid-Tier Prizes: Electronic appliances and devices (televisions, smartphones, laptops, mixers, grinders, etc.)
• Multiple Small Prizes: Consumer products available on Amazon, Flipkart, and other major e-commerce platforms
• Cash Vouchers: Gift cards and cashback vouchers for major e-commerce platforms (Amazon, Flipkart, Myntra)

The total number of prizes distributed per contest will be determined at the Company's discretion and may range from 100-110+ prizes, depending on contest parameters and sponsor arrangements.

3.2 Prize Eligibility
To be eligible for prizes, you must:
• Be at least 13 years of age (with parental consent if under 18)
• Have a verified mobile number registered on WhatAVote
• Not be a registered employee of WhatAVote or an immediate family member of our staff
• Not be in violation of any terms or conditions of this agreement
• Have participated in voting through legitimate means only
• Have your account in good standing with no violations

Employees of WhatAVote, their spouses, parents, siblings, and children are ineligible to win prizes.

3.3 Prize Selection and Winner Determination
Prize selection follows a transparent, randomized process:
• Not all votes cast are guaranteed to win prizes. Prizes are awarded through a randomized selection process from all eligible votes received.
• When a contestant wins a contest, the total votes received by that contestant enters the prize pool.
• The Company will randomly select 110 (or the designated number) winning votes from all votes cast for that winning contestant.
• Example: If a winning contestant receives 2,000 votes, the system will randomly select 110 of those 2,000 votes as prize-winning votes. Each of those 110 votes represents one prize awarded to the corresponding voter.

3.4 Public Winner Announcement
All winners are announced publicly through live streams on:
• Facebook
• Instagram
• YouTube

The live announcement process includes:
• Names and details of winning contestants
• Random draw/selection of winning voters using a transparent slip-picking method
• Live declaration of prize amounts and types
• Public verification of the randomization process

This transparent process ensures complete fairness and allows the community to witness the winner selection firsthand.

3.5 Prize Claim Process and Deadline

3.5.1 Notification of Winning
Winners will be contacted through:
• SMS/WhatsApp to the verified mobile number
• Email to the registered email address (if provided)
• If no email is provided, contact will be made exclusively via phone/WhatsApp

3.5.2 Claim Deadline
Winners have exactly 30 (thirty) days from the date of public announcement to claim their prize. This 30-day window is firm and non-negotiable.

3.5.3 Failure to Claim
• If we do not receive a response from you within 30 days, your prize will be forfeited.
• After 30 days, WhatAVote has no obligation to provide the prize.
• The Company is not liable for prizes not claimed within the designated timeframe.
• No extensions or exceptions will be granted for any reason whatsoever.

3.6 Prize Delivery and Collection

3.6.1 Shippable Products
Small prizes and shippable items (including but not limited to smartphones, earphones, tablets, laptops, kitchen appliances, televisions, etc.) will be shipped directly to your address. Shipping costs are borne by WhatAVote.

Delivery typically occurs within 7-14 business days after prize claim confirmation, subject to courier availability and address verification.

3.6.2 Non-Shippable Prizes (Grand Prizes)
Grand prizes such as automobiles and two-wheelers cannot be shipped and must be collected personally by the winner:
• Winners will be provided with collection details and location information
• A designated timeline will be provided for collection
• The winner is responsible for all transportation and logistics costs for collection
• The Company will facilitate the transfer of ownership documents and warranties
• Vehicle registration, insurance, and other post-purchase responsibilities are entirely the winner's responsibility

3.6.3 Gift Vouchers and Digital Prizes
Gift vouchers for e-commerce platforms (Amazon, Flipkart, Myntra) will be delivered via:
• SMS to the registered mobile number
• Email to the registered email address
• WhatsApp message

The winner must redeem these vouchers within the validity period specified by the respective e-commerce platform. WhatAVote is not responsible for expired or unredeemed vouchers.

3.7 Post-Purchase Responsibility
For all physical prizes (especially vehicles and appliances):
• WhatAVote is not responsible for product quality, defects, or malfunctions after delivery
• All warranty claims, repairs, and after-sales service must be directed to the manufacturer
• The winner assumes complete ownership and responsibility for the product
• WhatAVote cannot be held liable for any damage, loss, or issues with the prize after it is claimed
• For vehicles: Winner must handle all registration, insurance, and maintenance independently

3.8 Prize Modifications
The Company reserves the right to modify prize types, quantities, and values at its sole discretion. Any significant changes will be communicated to contestants through notification updates.

4. USER CONDUCT AND DISQUALIFICATION POLICY

4.1 Prohibited Conduct
Users must conduct themselves in a manner consistent with the community standards of WhatAVote. The following behaviors are strictly prohibited:
• Harassment, abuse, threats, or intimidation of other users or WhatAVote staff
• Posting or sharing defamatory, false, or misleading information
• Engaging in hate speech, discrimination, or offensive language
• Impersonating another user or individual
• Spamming or posting repetitive content
• Attempting to disrupt the normal functioning of the platform
• Engaging in any illegal activity

4.2 Voting Manipulation
Users caught engaging in any form of voting manipulation will face severe consequences:
• Immediate account suspension
• Permanent ban from WhatAVote platform
• Forfeiture of all prizes (won and pending)
• Disqualification from all current and future contests
• Possible legal action

4.3 Multi-Account Violation
A single user must use a single mobile number for registration and voting. Users found operating multiple accounts or voting through multiple phone numbers will be:
• Immediately disqualified from contests
• Permanently banned from the platform
• Required to forfeit all prizes associated with any of their accounts

4.4 Consequences of Violation
Any violation of these conduct standards may result in:
• Warning or suspension (first offense)
• Permanent account termination (subsequent offenses)
• Forfeiture of all prizes and rewards
• Legal prosecution if violations involve fraud or criminal activity
• Reporting to relevant authorities as deemed necessary

5. PAYMENT AND REFUND POLICY

5.1 Voting Costs
Voting on WhatAVote is entirely free. There are no charges, subscription fees, or payments required to register or cast votes. You will never be asked to pay to vote.

5.2 No Refund Policy for Paid Services
As voting is completely free, there is no refund policy applicable. However, if any technical error results in unexpected charges (which should not occur), please contact our support team immediately for resolution.

5.3 Prize-Related Transactions
Prizes won through voting contests are provided as rewards and are not subject to refunds or monetary exchanges. If you win a prize that you do not wish to accept, you may forfeit it, but no equivalent monetary compensation will be provided.

5.4 Responsibility for Prize Handling
Once a prize is claimed and transferred to you:
• You assume full ownership and responsibility
• All disputes regarding the prize quality, functionality, or delivery should be directed to the prize manufacturer or e-commerce platform, not WhatAVote
• WhatAVote is not responsible for any issues that arise post-delivery

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Platform Ownership
All content, design, graphics, code, logos, and materials on the WhatAVote platform are the exclusive intellectual property of WhatAVote. This includes:
• The WhatAVote brand name and logo
• Platform design and user interface
• All written content, images, and multimedia
• Software code and algorithms
• Contest mechanics and systems

6.2 User License
By using WhatAVote, you are granted a limited, non-exclusive, non-transferable license to use the platform solely for voting in contests. You may not reproduce, distribute, modify, or create derivative works of any platform content without explicit written permission.

7. LIMITATION OF LIABILITY

7.1 Disclaimer
WhatAVote shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

7.2 Third-Party Liability
WhatAVote is not responsible for the actions, content, or conduct of third parties, including but not limited to show creators, broadcast networks, or other users. Any disputes between you and third parties should be resolved directly with those parties.

7.3 Service Availability
While we strive to maintain uninterrupted service, WhatAVote does not guarantee that the platform will be available at all times. We are not liable for any downtime, technical issues, or service interruptions that may occur.

7.4 Force Majeure
WhatAVote shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, or government actions.

8. CHANGES TO TERMS

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new terms on this site. Your continued use of the Service following the posting of modified terms will constitute your acceptance of the changes.
